Ajax Cape Town begin their battle to stop the kickoff of the PSL season on Tuesday when they go to the South Gauteng High Court on Tuesday.
The Urban Warriors won their case against Safa arbitrator William Mokhari’s ruling to relegate them following the fallout of Tendai Ndoro’s ineligibility to play last season.
And as it stands, Ajax have been reinstated to 15th in the league and are now entitled to fight for their top-flight status in the playoffs.
But the PSL have appealed July 2 ruling by Judge Denise Fisher and are pressing ahead with plans for the season to kick off next weekend without Ajax.
Ajax will now return to the courts to ask for the Fisher’s judgment to be binding if the PSL, who are yet to submit an appeal, are given relief to challenge the ruling.
Should that be the case, the PSL will find it difficult to move ahead to start the league on August 3.
The Cape club believes that the punishment dealt out by Mokhari was harsh on them after the PSL’s own independent Dispute Resolution Chamber (DRC) initially cleared Ndoro.
Ajax never played the Zimbabwean without permission and not after the DRC’s decision was set aside after the PSL appealed.
