Abigail Ruiters might go back to jail after she failed to appear at the Western Cape High Court on Wednesday for her trial.
Ruiters, 30, is out on R2000 bail.
She and her berk, Ameerudien Peters, 26, are on trial for the rape and murder of her one-year-old son Jeremiah Ruiters in 2017.
It is alleged Peters raped, beat and then stabbed the tot at their Salamander Square home in Kensington.
He took the child to the local clinic, where the tot was declared dead.
Ruiters is charged with murder and child neglect under the Children’s Act.
The couple is facing two more charges of child abuse with regards to Ruiters’ two surviving children.
Ruiters was required to be at court by 9.30am. However, by 11am she was nowhere to be seen.
Her defence lawyer, Yasmin Rajap, tried to get a hold of her client.
VICTIM: Little Jeremiah Ruiters, 1
Rajap had received Ruiters’ number from Peters.
“I have tried calling her [Ruiters], but the number is not working. A member of the public has told me she lost her phone at the weekend.
“I am worried as she always comes [to court] no matter what her condition is,” Rajap said.
State prosecutor, Maria Marshall, then requested a warrant for Ruiters’ arrest.
“There is no reasonable explanation as to why she is not here,” Marshall said.
Judge Monde Samela showed mercy, saying: “The court takes into account she has been coming to court regularly. A warrant of arrest is authorised, but suspended until [today] at 9.30am.”
