The defence team for Lotus River dad, Moegsien Haywood, have won their application to access the information surrounding the undercover sting carried out by the Hawks which led to his arrest.
Haywood and his defence lawyers returned to the Mitchells Plain Magistrates’ Court on Thursday afternoon amid ongoing questions about what led up to his arrest in May this year where he allegedly tried to purchase AK47 rifles, hand grenades and explosives on the black market, which police sources say were meant to be used to bomb a prison truck and free his son, Ziyaad.
Moegsien along with his wife, Juleiga, were arrested for harbouring a fugitive in July 2018 after cops found Ziyaad hiding in a cupboard in their Lotus River home.
FACE JUSTICE: Dad Moegsien
The man known as the “closet killer” at the time was listed as one of the most dangerous criminals on the Cape Flats wanted on a string of charges including murder, attempted murder and armed robbery.
Moegsien’s lawyers brought the application for the information surrounding the undercover operation where he was arrested along with Luqmaan Lewis and Ismail Hendricks.
The State objected to the application, stating that a 204 witness statement had already been circulated among bandiete in Pollsmoor Prison.
The magistrate granted the application and gave Moegsien’s lawyers strict instructions that the name of the informer may not be released to him.
The case was postponed to 26 February for further investigations while Moegsien and Juleiga go on trial early next year at Wynberg Court for hiding their son.
