The case against a man arrested for firing a gun during a violent confrontation outside Brackenfell High School has been postponed.
Jaco Pretorius, 38, from Protea Heights, appeared at the Kuils River Magistrates’ Court yesterday morning.
Pretorius was part of a group of parents and residents who disrupted a protest by the EFF on Monday.
The party is calling for the suspension of the principal and teachers accused of being involved in staging a matric party for white pupils only.
Police were forced to step in when the two groups clashed. During the street brawl, Pretorius allegedly fired off the gun.
His case has been postponed to 25 January for further investigation and he is out on a warning, said National Prosecuting Authority spokesperson Eric Ntabazalila.
The EFF said six of its supporters were injured in Monday’s clashes, which included a woman, Sibongile Nkasayi, who was hit with a baseball bat, which was captured on video.
They have laid charges of assault.
A window of an EFF bakkie, which was emblazoned with a picture of party leader Julius Malema, was also shattered.
EFF Western Cape chairperson Wandile Kasibe insisted that it was some Brackenfell parents and residents who had sparked the violence.
“We were picketing peacefully (against alleged racism at the school). We’ve opened up cases against most of their members.”
On Tuesday, the school brought an urgent interdict application at the Western Cape High Court to prevent the EFF from protesting at the school.
Judge Siraj Desai said that the party had a fundamental right to protest.
“I want the exams to be written peacefully.
“The EFF is prepared to give an undertaking that it will not disrupt the matric exams on the understanding they are still allowed to protest.”
The EFF is contesting the interdict bid and the full application will be heard on Monday.
