Abigail Ruiters, the woman accused of murdering her one-year-old son along with her boyfriend, has been allowed to go back home.
A court order was granted
yesterday in the Western Cape High Court which allows Ruiters to return to Kensington.
Ruiters, 30, and her berk Ameerudien Peters, 26, are on trial for the rape and murder of one-year-old Jeremiah Ruiters in June 2017.
It is alleged Peters raped, beat and then stabbed the tot at their Salamander Square home.
He took the child to the local clinic, where the tot was declared dead on arrival.
Ruiters is charged with murder and child neglect under the
Children’s Act.
The couple is facing two more charges of child abuse with regards to Ruiters’ two surviving children.
Ruiters is currently out on R2 000 bail.
Her legal aid attorney, Yasmin Rajap, brought an application on behalf of Gail Ruiters, who previously testified for the state against her daughter.

“We ask for bail conditions to be scrapped. My client currently lives in Elsies River and we’re asking for her to move back home to Salamander Square.
“All witnesses from the area have testified and there is no danger,” Rajap submitted.
Rajap also told the court that it was expensive for Ruiters to travel from Elsies River to court.
“Travelling from Factreton is easier and cheaper than where she is staying now. She is not living with a family member and is 100 percent dependent on this person. Her mother (Gail) has asked for her to stay with her,” Rajap submitted.
State Prosecutor Maria Marshall had no objections.
As Judge Monde Samela granted the application, Ruiters smiled and had tears in her eyes.
