One of the men accused of being involved in the murder of controversial advocate Pete Mihalik says he doesn’t want to share a lawyer with his co-accused and wants his own legal counsel.
On Thursday, Magistrate Greg Jacobs allowed the media to photograph the trio in the Cape Town Magistrate's Court where they were expected to apply for bail.
Sizwe Biyela, 26, Nkosinati Khumalo, 31, and taxi owner Vuyile Maliti are facing charges of premeditated murder and attempted murder as well as the unlawful possession of a firearm and ammunition.
However, proceedings were stalled when Khumalo via his Legal Aid lawyer indicated he did not want to share legal counsel with Biyela.
The matter was postponed to 13 December for Khumalo to appoint a new Legal Aid lawyer.
Mihalik, 50, was gunned down outside his children’s school in Green Point on 30 October.
Two men approached Mihalik’s black Mercedes-Benz outside Reddam House and fired three shots through the driver’s side window
Mihalik’s eight-year-old son sustained a gunshot wound to his jaw. His daughter, 17, who was in the back seat, was not injured.
Maliti is from Kuils River, while the other two are from KwaZulu-Natal.
The three will remain in separate prisons for their own safety.
