The mother of slain Jeremiah Ruiters from Kensington, Abigail Ruiters, 30, and her 26-year-old berk Ameerudien Peters appeared after hours of delay as not the docket nor charge sheet or the presiding state prosecutor Adiel Jansen could be found.
The two were due to apply for bail but the application could not be heard due to the outstanding case docket.
Peters is now being represented by Advocate Alan Koester, and Ruiters by Advocate Illona Edwards, who both appeared irritated at the delay.
Koester claimed the delay was “tactical” because Jansen had not compiled a proper charge sheet against the accused.
“The belated documents are a concern, why did the state not compile a proper charge sheet which could have been drafted at the previous appearance?
“I submit the state gave us the runaround all day because the charge sheet was drafted this morning,” Koester said.
Edwards asked for a postponed as the State declined access to a copy of a warning statement of Ruiters.

“I would like to file an urgent application to the High Court to review the matter. I therefore ask for a postponement on the bail application as I cannot go forth without the documentation needed,” Edwards said.
Jeremiah was beaten, raped and stabbed to death in June at his home in Salmander Square.
His mother is charged with murder and child neglect, and Peters with murder and rape.
The matter was postponed to 25 August, pending the review of the application to the High Court.
