Alleged underworld kingpin, Nafiz Modack, is set to know his fate later this month after nearly eight months of bail hearings at the Blue Downs Regional Court.
Modack, along with Zane Kilian, Jacques Cronje, Ricardo Morgan and Anti-Gang Unit (AGU) officer, Ashley Tabisher returned, to court last week where the state and defence submitted their final arguments.
The five men face a string of charges relating to various incidents which led to the death of AGU top cop, Lieutenant-Colonel Charl Kinnear, who was killed outside his Bishop Lavis home in September 2020.
According to the state, Modack allegedly masterminded the murder and had planned to bomb Kinnear’s home by hiring someone to throw a hand grenade at the property while Kinnear’s family was inside.
While Morgan was granted bail during his first appearance, Kilian has since abandoned his application.
In the state’s arguments, they claim Modack is a flight risk, saying the true source of his income remains a mystery: “He is self-employed and trades motor vehicles, acts as a security advisor and deals in properties which he buys, refurbishes and sells.
“He is also faced with charges of tax fraud of R46 million and is being investigated in a separate case for car finance fraud involving an amount in the region of R46 million.
“Respondent submits that the true financial means of Applicant 1 remains a mystery to the court. The Applicant has provided little to no information about his financial status and means.”
The state also alleges that Modack is aware of the identities of the witnesses and claims he will go after them if released on bail.
The case was postponed to 19 January.
