A 40-year-old Anti-Gang Unit cop, who shot dead his partner, is now waiting for the Director of Public Prosecutions to decide whether they will prosecute him or not.
Marlin Appollis appeared in the Franschhoek Magistrates’ Court on Thursday.
It is understood Appollis accidentally shot his partner, 41-year-old Sergeant David Hoffman, once in the head.

Hoffman died on the scene.
Appollis played a pivotal role in the arrest and conviction of killers Henri van Breda and Jason Rohde.
His matter was postponed to 11 November as it was referred to the DPP who will decide whether to prosecute or not.
The crime scene photographs and a ballistic report are also still outstanding.

Independent Police Investigative Directorate (Ipid) spokesperson, Sontaga Seisa, said the cops were off-duty and were at a party in Franschhoek when the incident took place on Saturday, 17 August.
“It’s alleged that there was a braai at a private house attended by the deceased and the
suspect. The pair were off-duty.
“At the braai, the suspect pulled out his service pistol, and shot dead his 40-year-old
colleague.
“The motive for the killing is still unclear, and the Ipid investigation is continuing.”
According to colleagues, the two men were close friends and had been playing with their
service pistols at the party.
It is alleged that Appollis was playing with the safety on his firearm when it went off.
Appollis is out on R1000 bail.
