Western Cape High Court Judge Chantal Fortuin made the ruling yesterday in the trial within a trial, where Wilson claimed he was threatened, assaulted and “made” to sign an admission of guilt statement for the rape and murder of Stacey-Lee Mohale, and the attempted murder of her friend Abigail Plaatjies.
He also claims police did not read him his rights.
“I rule that the statement is admissible as evidence. The statement, however, will only be declared [as evidence] after the hearing,” Fortuin found.
Wilson, 20, is being tried on 15 charges including six counts of murder, three of attempted murder, rape and assault with the intent to do grievous bodily harm.
Following Fortuin’s ruling, the court proceeded with the murder trial and Warrant Officer Reese Jansen took the stand.
“When I booked him out of the cells on April 28, 2015... I informed him about the rape and told him he was identified,” Jansen explained.
“I told him I also had information which implicated him in the murder.”
Wilson then allegedly told the cop he would confess, and Jansen took down his statement.
In the statement, Wilson allegedly admits that on Friday, 24 April 2015, he and his 14-year-old friend, who has since turned state witness, saw Stacey-Lee and her friend in Dahlia Street, Heinz Park, and decided to rob them.
He claims the minor stabbed the girls first, before he joined in.
He says the boy then pelted the girls’ heads with bricks while they were lying on the ground, before placing an old tyre over them and setting it alight.
The trial resumes on Monday.
