DNA evidence, including a key witness in the case of the man dubbed the “fidget rapist”, is still outstanding.
Mark Heugh, 49, is accused of sexually assaulting a five-year-old girl in Mitchells Plain in August last year.
He made a brief appearance at the Mitchells Plain Regional Court on Monday where his plea and trial was set to start.
But this could not happen after it was revealed that the DNA report was still outstanding.
It’s also understood the man who rescued the girl has failed to pitch at court.
The little girl’s family claims the DNA evidence is “damning” and enough to convict Heugh.
They also called for more charges to be added.
“He wanted to kill her by choking her so that is attempted murder,” says the girl’s ouma.
“He must also face kidnapping charges because he lured her away from home.”
Another relative agrees: “The DNA evidence is very strong and he will be going down.”
The matter was postponed to 12 November for the DNA report and to located the witness.
It’s alleged Heugh lured the child away from her home to a nearby bush at Kapteinsklip Train Station and promised to buy her a fidget spinner.
He allegedly raped her twice before he was caught by a passer-by and ran off.
The man flagged down Law Enforcement officers and the girl identified her attacker to police.
An identity parade has been postponed several times because police have been unable to find men of similar description to take part in the
procedure.
