The defence team for the five people allegedly involved in the death of Ezra Daniels, 7, has been accused of stalling the case after another failed bail hearing on Thursday.
The alleged leader of the Junky Funkys gang, Tasliem “Thaliem” Bianchi, along with Ikeraam Bianchi, Marlon Neehuis, Kelly Daniels and Kimberley Solomons, appeared in the Wynberg Magistrate's Court as two of the accused had applied for bail.
Ikeraam and Neehuis were remanded in Pollsmoor Prison along with Thaliem late last year, while Daniels and Solomons were released on bail.
The two men initially said they did not want bail, but changed their minds and for several months now court proceedings have stalled.
Earlier this month their bail hearing came to a halt when the investigating officer informed Magistrate Goolam Bawa that the relatives living at the alternate addresses provided by Ikeraam and Neehuis declined to accommodate them, citing safety reasons.
Their lawyer asked for another postponement so the investigating officer could verify the addresses, but the State prosecutor objected.
“The defence had had since 11 May to provide addresses and they only gave it on Monday. There have been so many postponements and we should be ready for a regional court date, but we are postponing for addresses. The defence is stalling.”
The prosecutor said the investigation into the shooting is complete and the State was ready to proceed. Thaliem’s new lawyer, Bruce Hendricks, confirmed he would not be applying for bail.
Bawa postponed the bail hearing to 8 June.
