The men accused of shooting a girl who was playing outside her home will spend another six months in jail after their bail application was postponed.
The two are accused of killing little Emaan Solomons, 7, in February appeared at Simon’s Town Magistrate Court.
On Tuesday Eben Basson, 27, and Chivargo Fredericks, 20, were scheduled for bail.
National Prosecuting Authority Regional spokesman Eric Ntabazalila said: “The matter has been postponed to 23 Feb 2021 for the defence to address the court, whereafter it will be remanded to another date for judgment.
“Our prosecutor, Advocate Liezel Herbst submitted an affidavit with the petition and letters that we received from the Community Policing Forum and Mr P Franke from Ocean View which we received whilst at court.”
Investigating officer Sebranheim Meintjies, submitted an affidavit, which lists the accused, previous arrests and why they should not get bail.
Emaan was shot in her back and the bullet exited through her chest.
She was rushed to hospital where she was declared dead.
The letter reads: “Eben Basson and Chivargo Fredericks face aiding and abetting with criminal gang activity.
“Contributing to criminal gang activity, murder, four counts of attempted murder; two counts of the unlawful possession of a firearm.
“And two counts of the Contravention of Section 90 of Act 60/2000-The unlawful possession of ammunition which is punishable with a term of imprisonment of up to fifteen years.”
The cop added it is not in the interest of justice that they be released on bail with the evidence presented, and requested their application for bail be denied.
