Kaashif Toefy, owner of KT Constructs, says he had to fork out R12 500 after Law Enforcement officers fined him and impounded his truck.
On Tuesday 13 June, Law Enforcement told the Daily Voice they impounded the trokkie because the driver was illegally dumping rubble in Olieboom Road.
But Toefy showed the Daily Voice plans which indicate that the property Law Enforcement referred to is his own property.
“The property was transferred to me in February this year and we were actually removing the rubble that other people had dumped here,” he says.
Toefy says there are people living on the property and showed the Daily Voice planne for a new bicycle track and a road.
On 13 June, when the officers arrived, Toefy says they were using some rubble to create the road by making the ground stronger.
Area Mayco member, Eddie Andrews, says Toefy was dumping and performing unauthorised infilling, which is prohibited by law.
“The owner is required by law to obtain written permission from the Department of Environmental Affairs and Development Planning to undertake infilling on his property,” Andrews said.
“The case is closed as the offender has paid an admission of guilt fine, thereby acknowledging guilt.”
However, Toefy is adamant he is innocent.
“This is my property, not an open space. The only reason I paid the fine is so that I could get my truck back,” he says.
