SENTENCED: Pakiso Panyana as a teen

Grabouw man admits to brutal attack on girl, 14.

This Grabouw man has been sentenced to 25 years in prison after he pleaded guilty to raping and attempting to kill a 14-year-old girl.

Pakiso Panyana, who was 22 years old at the time of the attack, yesterday entered into a plea and sentencing agreement with the state at the Western Cape High Court.

Panyana was charged with two counts of rape, attempted murder, robbery and kidnapping after he attacked the teen from his neighbourhood in July 2015.

Panyana grabbed the girl as she was walking home and, armed with a screwdriver, he robbed her of R20 before raping her twice, stabbing her in the neck and pelting her with rocks.

Relatives of the teenager; who spent a month in hospital recovering from her injuries had recalled how the learner survived the attack by pretending to be dead before walking home naked with only her underwear hanging from her bleeding neck.

According to his plea deal statement, Panyana admitted that on the day of the crime, he spotted the victim while walking past a cemetery.

“He demanded money from her, wielding a screwdriver, and she gave him a R20.”

“Then he took her to the bushes against her will, he demanded to have sexual intercourse with her and she refused.

“He then tied her hands with a scarf and wire, he proceeded to have intercourse by penetrating her vaginally without her consent. He did so twice.

“He stabbed her with a screwdriver driver to the neck once, (then) threw rocks to her head many times.

“When he left her, she was bleeding from her mouth and he was convinced she was dead as she lay still.”

In sentencing, the court took considered the accused showed remorse by pleading guilty and he had cooperated with police.

He also had no prior convictions for sexual or violent cases.

Judge President Yahya John Hlophe then sentenced him to 12 years for robbery, five for kidnapping, 25 years for both counts of rape and another 10 years for attempted murder.

Judge Hlophe ordered that all the other sentences run concurrently with the 25-year jail term.

He further ordered that the accused may only apply for parole after serving 15 years and that his name be added to the register for sexual offenders.

The victim did not attend the court proceedings.
